Agreement

These Terms of Service govern your use of AI Color Analysis at aicoloranalysis.net. By using the service, creating an account, submitting a photo, or purchasing a report, you agree to these terms and our Privacy Policy. If you do not agree, do not use the service.

The Service

AI Color Analysis provides an automated personal color estimate based on a photo you choose to submit. The free result may include seasonal matches, a representative palette, explanations, and photo-quality notes. An eligible analysis may offer an optional one-time purchase of a Full Color Report with an expanded palette and styling guidance.

The result is a digital estimate, not an expert-certified diagnosis, medical advice, or a guarantee that particular colors will suit every camera, display, lighting condition, or personal preference. The current engine and calibration version are shown with the result where available.

Eligibility and Accounts

You must be legally able to enter this agreement. If you use the service for a minor, you confirm that you have the authority required by applicable law.

You are responsible for accurate account information, protecting your credentials, and activity under your account. Notify support@aicoloranalysis.net promptly if you suspect unauthorized access.

Photos and Your Permission

You may submit only a photo that you own or are authorized to process. Do not submit another person's image without their informed permission. By starting an analysis, you instruct us to process the image for the purposes described in the Privacy Policy and confirm the on-screen consent.

You retain ownership of your photo. Your browser performs normalization on your device; the original encoded file is not uploaded, but the full normalized pixel image is. You grant us a limited, temporary right to host, analyze, and delete that pixel image solely to operate and secure the requested service. You do not grant us permission to sell it, use it for advertising, or train a general-purpose AI model.

Purchases and Delivery

When paid checkout is available:

• The Full Color Report is a one-time digital purchase, not an automatically renewing subscription.
• The product price, currency, and applicable taxes are displayed before you confirm payment.
• Creem acts as Merchant of Record and handles payment processing, tax collection, receipts, refunds, and payment disputes.
• Delivery occurs when the purchased report becomes available in the purchasing account.

Report access is intended to remain available in your account while the account and service remain active. Access may be removed after a refund, chargeback, payment dispute, fraudulent purchase, legal requirement, account deletion, or material breach of these terms.

Refunds

Our Refund Policy is part of these terms. Refund requests should be sent to support@aicoloranalysis.net with the purchase email and enough information to locate the order. Nothing in these terms limits non-waivable consumer rights.

Acceptable Use

You must not:

• Submit images you do not have the right or permission to process.
• Use the service for facial recognition, identity verification, surveillance, face swapping, deepfakes, harassment, discrimination, or unlawful profiling.
• Attempt to bypass usage limits, security controls, access checks, payment requirements, or report entitlements.
• Probe, disrupt, overload, reverse engineer, or introduce malicious code into the service, except where applicable law expressly permits security research.
• Use the service or its output in a way that violates law, infringes rights, or causes harm.

We may limit or suspend access when reasonably necessary to protect users, the service, payment integrity, or legal compliance.

Intellectual Property

We retain rights in the service software, design, text, generated report format, and other materials we create. Subject to these terms, you may use your generated result and purchased report for personal, non-commercial purposes, including printing or saving a personal copy. Third-party names and services remain the property of their respective owners.

Service Availability and Changes

We may update the analysis engine, calibration, features, limits, prices, or providers. We may suspend or discontinue parts of the service for maintenance, security, legal, or operational reasons. We do not guarantee uninterrupted availability, that every photo will pass quality checks, or that results from different photos or engine versions will match.

Disclaimers

To the extent permitted by law, the service and its output are provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement where those disclaimers are legally permitted. You remain responsible for how you interpret and use style guidance.

Limitation of Liability

To the extent permitted by law, AI Color Analysis will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or opportunities arising from use of the service. Our aggregate liability relating to a paid report will not exceed the amount you paid for that report. These limits do not apply where liability cannot legally be limited.

Account Closure and Termination

You may request account closure by emailing support@aicoloranalysis.net. We may suspend or terminate access for fraud, abuse, security risk, non-payment, unlawful conduct, or material violation of these terms. Sections that by their nature should survive termination, including payment records, intellectual property, disclaimers, and liability limits, will survive.

Changes to These Terms

We may update these terms as the service or legal requirements change. The date at the top shows the latest revision. Material changes will be communicated through the website or account when appropriate. Continued use after an update means you accept the revised terms to the extent permitted by law.
